Introduction

These General Terms and Conditions of Sale govern purchases of products and services made remotely by the purchaser via the Internet on the website www.mygioiajewels.com (the “Site”), owned by MYGIOIA (the “Company”), VAT number 02598220974.

All contracts for the purchase of products concluded through the Site are governed by these Terms and Conditions, which shall be deemed accepted in full whenever an order is placed on the Site.

All prices published on the Site are indicated in euros and are understood to be public prices including VAT pro tempore in force. The Company reserves the right to change prices at any time without prior notice.

Such acceptance shall be deemed tacit unless otherwise communicated in any manner to the Customer. By placing an order in the various ways provided, the Customer declares that he/she is of legal age and has read all the information provided to him/her during the purchase procedure, and that he/she fully accepts the general conditions of sale and payment set forth below.

The Customer may purchase the products visible on the Site as described in the relevant information sheets at the time of placing the order. The correct receipt of the order is confirmed by the Company by means of an e-mail reply, automatically sent to the e-mail address provided by the Customer. The message repeats the items ordered and all the data entered by the Customer, who undertakes to verify their correctness and promptly communicate any corrections.

The Company reserves the right to delete, add and change the products on the site without notice.

Order Management
For each product selected on the Site, a summary page is available containing the product photo, product format, product code, number of products selected, unit price of the product(s), and the total price of the products referred to in the current order. Before confirming your order, please carefully verify that the product selection you have made is correct.
Any order placed on the Site assumes the provision, at the time of ordering, of accurate information, such as: last name, first name, i.e. company, telephone and fax number, e-mail address, billing address and delivery address. At the end of the order procedure, you will be asked to accept the entirety of the General Terms and Conditions and those related to Privacy.

Upon completion of the procedure, the order will be transmitted to the Company for processing.
This order can no longer be modified or cancelled except by contacting Customer Service by e-mail at: info@mygioiajewels.com.

Right of Withdrawal
All products purchased through the Site may be returned within 30 days from the date of receipt of the goods. To return what has been purchased, a return request must be completed and sent to info@mygioiajewels.com
The right of withdrawal cannot, however, be exercised by the Consumer in case of purchase of Gift Vouchers or in relation to items that, by their nature, are not suitable to be returned

Contract termination, express termination clause, exclusion of liability
The Company reserves the right to terminate the contract entered into by giving simple notice to the Customer indicating the reason. In this case, the Customer shall be entitled only to a refund of any amount already paid.
Any right of the Customer to compensation or indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages, and in particular, by way of example, for loss of business, profit or opportunity resulting from or consequent to the purchase of products on the Site, to persons and/or things, related to the execution and/or non-acceptance, even partial, of an order and this also for reasons of stock shortage or unavailability of products.
No responsibility can be attributed to the Company for delayed or non-delivery attributable to force majeure or fortuitous events.
The Company is not responsible for damage caused by the carrier to the purchased products.

Conditions
The conditions contained herein may be updated and/or modified by the Company, without prior notice and effective from the date of publication on the Site, effective only for contracts yet to be entered into and not for those already in effect at the time of the changes. In these cases, the Customer undertakes and is obliged, whenever a modification of these General Conditions occurs, to ensure that they are printed and preserved.

Warranty
All products sold by the Company are covered by the conventional manufacturer's warranty and by the 24-month warranty (12 months in case of purchase with invoice) for conformity defects, pursuant to Legislative Decree 206/05. To take advantage of warranty service, the Customer must keep the invoice or receipt he/she will receive.

The 24-month warranty
Pursuant to Legislative Decree No. 24/02 applies to the product that presents a lack of conformity, provided that the same is used correctly, in accordance with its intended use and as provided in the attached technical documentation. This guarantee, in accordance with Dlgs. N. 24/92, is reserved only for the private Consumer (natural person who buys the goods for purposes not related to his professional activity, or makes the purchase without indicating in the order form a reference of VAT). In case of lack of conformity, the Company will provide, without cost to the customer, the restoration of conformity of the product by repair / replacement or reduction of the price, until the termination of the contract.
